TERMS OF USE
(public offer for the use of the AEGIS mobile application)

1. General provisions
1.1. These Terms of Use (the “Agreement”) constitute a public offer and govern the relationship between Limited Liability Company «АЕГИС» (OOO «АЕГИС», TIN 1683034413, PSRN 1261600033562) (the “Operator”) and the user of the AEGIS mobile application (the “User”, the “Application”).
1.2. Installing and using the Application means the User’s full and unconditional acceptance of the terms of this Agreement.
1.3. The Application may be used by persons who have reached the age of 18, or by minors solely within an account added to a family by an adult member in the manner provided by the Application’s functionality.
2. Description of the service
2.1. AEGIS is an application for mutual safety within a family, offering the following functionality:
SOS signal — an emergency alert to family members with transmission of geolocation, audio and video streams
SafeWalk — real-time escort of the User by the family for the duration of the selected route/session
Safety timer — if the User has not confirmed that they are safe by the set time, the Application automatically, without additional confirmation, initiates an SOS signal on their behalf: transmission of geolocation and broadcasting of audio and video streams to family members are switched on, on the same terms as when an SOS signal is sent manually
Safe zones — defining geofences and the presence status of family members within them
Shared family document storage
Activity feed — a history of SOS and SafeWalk events within the family
3. IMPORTANT: The Application does not replace emergency services
AEGIS is NOT a substitute for calling emergency services (112, police, ambulance, the Ministry of Emergency Situations). The Application transmits a signal only to the User’s family members within the Service and does not send automatic requests to state emergency services. The Operator does not guarantee round-the-clock availability, speed or uninterrupted transmission of the SOS signal, owing to its dependence on internet connectivity, the operability of the device and other factors beyond the Operator’s control. In a situation of real threat to life and health, the User should first of all contact emergency services directly.
4. Terms of use of monitoring functions (SOS, SafeWalk)
4.1. The functions for transmitting geolocation, audio and video streams are intended EXCLUSIVELY for use within a single family in the Application, all of whose members have joined it voluntarily and have given consent to data processing in the manner provided by the Personal Data Processing Policy.
4.2. The User undertakes not to use the Application’s functionality for:
Covert surveillance of a person who has not given voluntary and informed consent to it
Coercing another person to join a family in the Application by threats, deception or any other unlawful means
Monitoring persons who are not members of the User’s family in the Application
Any actions that violate the rights and legitimate interests of third parties, including the right to privacy
The Application is not designed for covert surveillance: while an audio or video stream is being transmitted, the monitored User sees an indicator on the device screen and can stop the transmission at any time; geolocation is shown to the family on the family map for as long as the User is a member of the family, which the User agrees to when joining. The exception is an SOS signal raised by the User themselves with a duress code or a voice command: it is sent without visible signs on the screen of the person raising it, so as not to put them at risk, and all family members are alerted. An attempt to use the Application for covert surveillance of another person is a violation of this Agreement and may result in the account being blocked.
4.3. The Operator reserves the right to block the User’s account upon receiving reasonable information about the use of the Application for the purposes specified in clause 4.2.
5. Rights and obligations of the parties
5.1. The User undertakes to:
Provide accurate data at registration
Independently ensure the safekeeping of their account login credentials
Use the function of adding family members only in respect of real members of their family or persons with whom the User has a relationship of trust implying mutual consent to the use of the Service
5.2. The Operator undertakes to:
Ensure the functioning of the Application in accordance with its purpose
Process the User’s personal data in accordance with the Personal Data Processing Policy
Notify Users of material changes in functionality affecting the processing of personal data
6. Limitation of liability
6.1. The Application is provided “as is”. The Operator is not liable for:
The impossibility of transmitting an SOS signal or a SafeWalk session for reasons beyond the Operator’s control (no internet connection, a discharged or faulty device, failures of the device’s operating system)
A delay in delivery of an SOS signal sent by voice command through the device’s system voice assistant when there is no internet connection at the time it is sent, as well as erroneous non-activation or inaccurate triggering of this function, which depends on the correct recognition of the command by a third-party voice assistant of the device that is not under the Operator’s control
The automatic sending of an SOS signal by the “Safety timer” function because the User did not have time to, or forgot to, confirm that they are safe before the expiry of the timer set by the User themselves (or by the family owner — for another member), including cases where such automatic sending turned out to be unnecessary
Actions or inaction of the User’s family members in response to a received SOS signal
Damage resulting from use of the Application in a manner that violates the terms of clause 4.2 of this Agreement
6.2. The limitations of liability provided for in this section apply to the maximum extent permitted by the legislation of the Russian Federation, and do not apply where such a limitation is expressly prohibited by mandatory norms of the legislation of the Russian Federation on consumer protection.
7. Intellectual property
7.1. All rights to the Application, including the software code, design and the “AEGIS” trademark, belong to the Operator or are used by it on lawful grounds.
7.2. The User is granted a simple (non-exclusive) license to use the Application for personal, non-commercial purposes in accordance with its purpose.
8. Term and termination
8.1. The Agreement is effective from the moment the Application is installed until the User deletes the account or the Operator blocks the account.
8.2. The User may at any time delete the account and stop using the Application.
9. Governing law and dispute resolution
9.1. This Agreement is governed by the law of the Russian Federation. The parties shall seek to resolve all disputes and disagreements arising in connection with the performance of this Agreement through negotiations. If no agreement is reached, the dispute shall be resolved in court in accordance with the legislation of the Russian Federation, taking into account the right of a User who is a consumer to choose to apply to a court at their place of residence or stay, at the place of conclusion or performance of the Agreement, or at the Operator’s location — in accordance with Article 17 of the Russian Federation Law “On Consumer Rights Protection”.
10. Final provisions
10.1. The Operator may unilaterally amend this Agreement by publishing the current version in the Application.
10.2. All matters not settled by this Agreement are resolved in accordance with the applicable legislation.
